The Degennaro v. Oakville Trafalgar Memorial Hospital court decision was released by the Ontario Superior Court of Justice on July 2, 2009
On May 19, 1999, Diane Degennaro two-year old son became ill with flu-like symptoms. She took her son to the hospital at 1:15 a.m. that evening and they were admitted into a hospital room. Ms. Degennaro wanted to phone her husband and sat on a hospital bed near to a telephone. Suddenly, the end of the bad collapsed and she fell heavily on the floor landing on her buttocks and lower back. She felt terrible pain and a nurse in the room helped her up and sat her on the bed. She stayed the night at the hospital with her son and her son was discharged after three days.
Ms. Degennaro continued to experience severe pain after her accident. She returned to the hospital on May 31, 1999 and was diagnosed with a fractured sacrum. Read the rest of this entry »

The Williamson v. Suna court decision was released by the Supreme Court of British Columbia in Victoria on April 29, 2009.
On the evening of February 27, 2004, David Williamson, then a Master Corporal with the Canadian Armed Forces, was waiting in the left-hand turning lane when he was suddenly struck head-on by another vehicle. After the accident, Mr. Williamson did not go to the hospital but rather was driven home by a police officer. The Hibberd v. William Osler Health Centre slip & fall court decision was released by the Ontario Superior Court of Justice in Toronto on February 13, 2009.
Dr. Jennifer Hibberd, a highly regarded pediatric dental surgeon, was scheduled to perform surgeries on 6 patients on the day of May 26, 2003 at the William Osler Health Centre hospital in Toronto. In between surgeries, she was walking down a corridor when suddenly her legs went out from underneath her and she fell to the ground. As she put out her left arm to break the fall, she broke her left wrist. The floor had just been mopped by a hospital janitor. Read the rest of this entry »

The Mahe v. Boulianne court decision was issued by the Alberta Court of Queen’s Bench in Edmonton on December 17, 2008.
In October 1998, Ernest Boulianne hired electrician Michel Mahe to move the electrical wires from a wooden pole in his yard to a new pole which had been installed. As Mr. Mahe cut the remaining wires on the old pole, the pole began vibrate and shake, causing Mr. Mahe to fall 20 feet on to the ground face-first.
Mr. Mahe was transported to the St. Paul hospital. He suffered multiple fractures of the upper thoracic vertebra T1 to T5 including compression fractures of the T3 and T4 vertebra of his spine. He also had two fractured ribs and the muscles to his shoulder blades were torn. Read the rest of this entry »

The Madonia v. Stevens court decision was released by the Ontario Superior Court of Justice on December 12, 2008.
On July 15, 2005, Laura Madonia attended at their cardiologist’s office for an electrocardiogram. Amongst other heart ailments, she suffered from hypertrophic cardiomyopathy and had a thickening of the heart muscle in the septum area of her heart. The cardiologist interpreted the results as showing atrial fibrillation (abnormal heart rhythm) and prescribed anti-coagulation medication for that condition.
Three weeks later, Mrs. Madonia attended Joseph Brant Hospital suffering from bleeding. Read the rest of this entry »

The Greaves v. Grace court decision was released by the British Columbia Supreme in New Westminster on November 10, 2008.
On the night of February 13, 2005, Randy Greaves and his friend and employer Darren Grace were having drinks at the Maple Ridge Pub. They left after two or three hours and were both intoxicated. They climbed into Darren’s GMC pick-up truck and Darren began driving Randy home.
Approximately 15 minutes later while on the Lougheed Highway, Darren suddenly veered into right which he later stated was to avoid an accident. He lost control of the truck and his car began to slide across the median and then flipped over on to the driver’s side and into a ditch. Read the rest of this entry »

The Skocir v. Premier Fitness Clubs (Yorkdale) Inc. court decision was released by the Ontario Superior Court of Justice on November 7, 2008.
Matilda Skocir, age 72, attended her gym in Toronto, Ontario, on December 14, 2006 for her regular workout. After she finished, she was stretching on the floor when suddenly one of the weight machines toppled over on her, landing on her legs and left arm.
Ms. Skocir suffered extensive bruising to her left arm, a curved gash encircling the left ankle and an inverted “V” laceration on her right calf in front. Ms. Skocir was taken by ambulance to the Humber River Regional Health Centre where her wounds was stapled and then she was discharged. Read the rest of this entry »

The Chowdhry vs. Burnaby (City) court decision was released by the British Columbia Supreme Court in Vancouver on October 10, 2008.
On August 19, 2005, Shanker Chowdhry, than age 64, was driving his Honda Civic north on Cariboo Road in Burnaby. While driving, he was speaking on his cell phone with his wife when suddenly he saw a City of Burnaby garbage truck coming toward him around a curve at high speed and out of control.
Mr. Chowdhry saw the garbage truck was tipping over toward him and drove to the extreme right of the road. He tried to get out the passenger door but before he could do so the garbage truck fell on his vehicle, crushing the driver’s door and the left front wheel area and smashing the windshield. The Ufimzeff v. Brown court decision was released by the British Columbia Supreme Court in Kelowna on September 2, 2008.
On June 15, 2005, then 60 year-old Raisa Ufimzeff was driving in Vernon, British Columbia when a Chrysler pulled out of an alley and struck her car. She hit her chest the force of the collision dazed her. Her daughter came and took her to the hospital where she was released the same day and told that she had injured the muscles in her chest.
Over the next several days, Ms. Ufimzeff began to feel worse. She went to visit her family doctor and reported pain in her sternum area. X-rays revealed an undisplaced fracture of her sternum. Read the rest of this entry »

The Bradley vs. Bath decision was released by the British Columbia Supreme Court in Vancouver on August 5, 2008.
On December 3, 2003, 23-year old Ryan Bradley was riding his bicycle to his brand new job. He was riding on the sidewalk and not wearing a helmet. As he crossed the exit of a gas station, he was suddenly struck on the left leg by a Mercedes exiting the gas station. He was knocked off his bicycle and was thrown approximately 15 feet into the centre lane of the street. He landed on his right hip and struck his head against the pavement.
