Canadian Soldier Suffers Brain Injury in Head-On Collision

The Williamson v. Suna court decision was released by the Supreme Court of British Columbia in Victoria on April 29, 2009.

On the evening of February 27, 2004, David Williamson, then a Master Corporal with the Canadian Armed Forces, was waiting in the left-hand turning lane when he was suddenly struck head-on by another vehicle. After the accident, Mr. Williamson did not go to the hospital but rather was driven home by a police officer. Passenger Sues Intoxicated Friend after Truck Slides into Ditch

The Greaves v. Grace court decision was released by the British Columbia Supreme in New Westminster on November 10, 2008.

On the night of February 13, 2005,  Randy Greaves and his friend and employer Darren Grace were having drinks at the Maple Ridge Pub. They left after two or three hours and were both intoxicated. They climbed into Darren’s GMC pick-up truck and Darren  began driving Randy  home.

Approximately 15 minutes later while on the Lougheed Highway, Darren suddenly veered into right which he later stated was to avoid an accident. He lost control of the truck and his car began to slide across the median and then flipped over on to the driver’s side and into a ditch. Read the rest of this entry »

B.C. Man Develops PTSD after Accident with Garbage Truck

The Chowdhry vs. Burnaby (City) court decision was released by the British Columbia Supreme Court in Vancouver on October 10, 2008.

On August 19, 2005, Shanker Chowdhry, than age 64, was driving his Honda Civic north on Cariboo Road in Burnaby. While driving, he was speaking on his cell phone with his wife when suddenly he saw a City of Burnaby garbage truck coming toward him around a curve at high speed and out of control.

Mr. Chowdhry saw the garbage truck was tipping over toward him and drove to the extreme right of the road. He tried to get out the passenger door but before he could do so the garbage truck fell on his vehicle, crushing the driver’s door and the left front wheel area and smashing the windshield. B.C. Farmer Fractures Sternum in Car Accident

The Ufimzeff v. Brown court decision was released by the British Columbia Supreme Court in Kelowna on September 2, 2008.

On June 15, 2005, then 60 year-old Raisa Ufimzeff was driving in Vernon, British Columbia when a Chrysler pulled out of an alley and struck her car. She hit her chest  the force of the collision dazed her. Her daughter came and took her to the hospital where she was released the same day and told that she had injured the muscles in her chest.

Over the next several days, Ms. Ufimzeff began to feel worse. She went to visit her family doctor and reported pain in her sternum area. X-rays revealed an undisplaced fracture of her sternum. Read the rest of this entry »

Vancouver Cyclist Hit by Car while Riding to New Job

The Bradley vs. Bath decision was released by the British Columbia Supreme Court in Vancouver on August 5, 2008.

On December 3, 2003, 23-year old Ryan Bradley was riding his bicycle to his brand new job. He was riding on the sidewalk and not wearing a helmet. As he crossed the exit of a gas station, he was suddenly struck on the left leg by a Mercedes exiting the gas station. He was knocked off his bicycle and was thrown approximately 15 feet into the centre lane of the street. He landed on his right hip and struck his head against the pavement.

Vancouver Tax Driver Rear-Ended on the Job

The Niloufari vs. Coumont court decision was released by the British Columbia Supreme Court in Vancouver on June 24, 2008.

On January 9, 2006, taxi driver Ebrahim Niloufari was driving his taxi across the Granville Bridge in Vancouver. He was stopped at a crosswalk waiting for a cyclist to pass when he was suddenly rear ended by the Jeep Cherokee.

While the taxi suffered substantial damage, Mr. Niloufari did not go to the hospital. Rather, he went into another taxi and was driven to his employer’s office where he filled out a report.  Read the rest of this entry »

Pedestrian Hit By Car While Crossing Street in Whistler

The Prasad v. Sedivy court decision was released by the British Columbia Supreme Court on April 14, 2008.

On December 3, 2002, Praneel Prasad was walking across a marked crosswalk in Whistler, B.C., when he was suddenly hit by a car. He flew over the hood of the defendant’s vehicle and his face smashed into the windshield. He then was thrown off the car landing on the pavement.

As a result of the collision, Mr. Prasad sustained facial cuts, a fractured nose, soft tissue injuries to the neck, back and left knee, and a concussion. Read the rest of this entry »

Visa Student Suffers Brain Injury after Struck by Hummer

The Dikey vs. Samieian court decision was released by the British Columbia Supreme Court on May 16, 2008.

Murat Dikey was a young Turkish national living in Canada on a student Visa.  On June 16, 2004, he was standing in a roadway in West Vancouver, B.C. when he was suddenly struck by a Hummer sports utility vehicle. The force of the impact caused Mr. Dikey to fly about 50 feet and smash into a concrete wall with his head.

Mr. Dikey lost consciousness at the scene. He was taken to Lions Gate Hospital by Emergency Health Services.  Read the rest of this entry »

BC Woman Injured after Rear-Ended by Tractor Trailer

The Pelkinen v. Unrau court decision was released by the British Columbia Supreme Court on March 28, 2008.

On July 5, 2004, Ella Pelkinen was stopped at a red light in Aldergrove, B.C. when a tractor-trailer crashed into her Saturn from her behind.  The force of the crash broke the back of the front passenger seat and threw Ms. Pelkinen from the front passenger seat to a prone position on the rear seat of her car.  She had to be helped out of the vehicle by paramedics and was taken to the Langley Memorial Hospital whereshe was discharged the same day.

Ms. Pelkinen’s immediate symptoms were headache, pain in the left side of the neck, light headedness, and shoulder pain. Read the rest of this entry »

B.C. Man Awarded Damages for Soft Tissue Injuries

The Dewitt v. Takacs court decision was released by the British Columba Supreme Court in Chilliwack on March 13, 2008.

Arthur Dewitt was a steel fabricator who’s job required heavy work involving lifting, climbing, and maneuvering heavy pieces of equipment and steel. On January 9, 2004, he was suddenly rear-ended by another vehicle and pushed into the on-coming lane where he was struck by another vehicle. His face hit the steering wheel with considerable force and some of his teeth were loosened. He went to the hospital and complained about his neck and his back.

As a result of the accident, Mr. Dewitt suffered soft-tissue injuries to his low back and neck. Read the rest of this entry »
