Hospital Bed Fall Results in Multi-Million Dollar Damage Award

The Degennaro v. Oakville Trafalgar Memorial Hospital court decision was released by the Ontario Superior Court of Justice on July 2, 2009

On May 19, 1999, Diane Degennaro two-year old son became ill with flu-like symptoms. She took her son to the hospital at 1:15 a.m. that evening and they were admitted into a hospital room. Ms. Degennaro wanted to phone her husband and sat on a hospital bed near to a telephone. Suddenly, the end of the bad collapsed and she fell heavily on the floor landing on her buttocks and lower back. She felt terrible pain and a nurse in the room helped her up and sat her on the bed. She stayed the night at the hospital with her son and her son was discharged after three days.

Ms. Degennaro continued to experience severe pain after her accident. She returned to the hospital on May 31, 1999 and was diagnosed with a fractured sacrum. Read the rest of this entry »

Dental Surgeon Sues Toronto Hospital after Slip and Fall on Mopped Floor

The Hibberd v. William Osler Health Centre slip & fall court decision was released by the Ontario Superior Court of Justice in Toronto on February 13, 2009.

Dr. Jennifer Hibberd, a highly regarded pediatric dental surgeon, was scheduled to perform surgeries on 6 patients on the day of May 26, 2003 at the William Osler Health Centre hospital  in Toronto. In between surgeries, she was walking down a corridor when suddenly her legs went out from underneath her and she fell to the ground. As she put out her left arm to break the fall, she broke her left wrist. The floor had just been mopped by a hospital janitor.  Read the rest of this entry »

Burlington Woman Fractures Femur in Sidewalk Slip & Fall

The Cartner v. City of Burlington court decision was released by the Ontario Superior Court of Justice on July 29, 2008.

On November 8, 2002, 52 year-old Marjory Cartner was walking from the bus stop to work with a friend and co-worker. Suddenly, her leg twisted and slid out from under her on the sidewalk and she fell and severely fractured her right femur.  She had slipped on a muddy concrete substance that had pooled on the sidewalk. The substance emanated from a shoe store which was in close vicinity to the sidewalk.

As a consequence of the slip and fall, Ms. Cartner underwent a total right knee replacement in July 2006. She faced two potential further surgeries to repair her left knee and leg as a result of the osteoarthritis Read the rest of this entry »

Woman Tears Achilles Tendon after Slipping in Wal-Mart

The Godden vs. Wal-Mart Canada Corp. court decision was released by the Newfoundland and Labrador Supreme Court on January 4, 2008.

On October 3, 2003, Elizabeth Godden was shopping at the Wal-Mart in Mount Pearl Newfoundland & Labrador. She was pushing a shopping cart and walking in the direction of the customer service desk when she suddenly slipped on slippery floor. An off-duty employee had spilled a coffee on the floor and the clean-up occurred only minutes before the slip.

As a result of losing her balance, Ms. Godden tightly grasped the handle of the shopping cart which avoided a fall to the floor. Read the rest of this entry »

Hamilton Senior Fractures Femur after Falling into Trench

The Singer v. Hamilton (City) court decision was released by the Ontario Superior Court on November 5, 2007.

On September 9, 1999, Margaret Singer, then age 78, had been working at her shop in Effort Square when she decided to go to buy some candles at a nearby store. There was construction in the area as the City of Hamilton was installing conduits for electrical cables. As she was walking, she suddenly fell into a deep trench, fracturing her right femur badly.

Ms. Singer stayed one week at Hamilton General Hospital and was then transferred to the Henderson General Hospital for rehabilitation, where she remained for two weeks. Later she attempted suicide because of the combination of her grieving the loss of her husband and the fracture of her leg, which caused her pain and immobility. Read the rest of this entry »

Kamloops Senior Breaks Hip in Slip & Fall at Public Library

The Simon v. Strata Plan KAS2093 court decision was released by the British Columbia Supreme Court in Kamloops on October 17, 2007.

On the night of February 28, 2000, 67-year old Florence Simon was on her way to the Kamloops Public Library to take out some books to read. She parked her car and began walking towards the main entrance. It was dark and the sidewalks and road surface were wet. As she descended the stairs, she suddenly slipped and fell down the stairs.

Ms. Simon lay at the foot of the stairs unable to get up for some time. Finally, an ambulance was called and took her to Royal Inland Hospital where Ms. Simon was hospitalized for six days. As a result of the fall, the plaintiff broke her left hip and heel. Read the rest of this entry »

London Shopper Sues after Slip & Fall at Store Entrance

The George v. Convent Garden Market Corp. court decision was released by the Ontario Superior Court of Justice in London on July 25, 2007.

On February 7, 2002, Maria George was entering the Convent Garden Market in London, Ontario, when her right foot suddenly caught a buckled area of the entrance mat. She fell forward with into the left side of the door frame, striking her head on the frame and then rebounded backward falling on her back and hitting her head on the floor.

Ms. George, who was dazed by the slip & fall, was taken by ambulance to the London Health Sciences Centre. X-rays of her neck showed a localized prevertebral soft tissue swelling at the C5-6 level. Read the rest of this entry »

Woman Fractures Ankle after Slipping in Snowy Parking Lot

The Flentje v. Nichols court decision was released by the Ontario Superior Court of Justice on September 21, 2006

On January 18, 2002, Sylvia Flentje was crossing the parking lot leading to the entrance of the Buckhorn Restaurant and Bar in Calabogie, Ontario when she suffered a slip & fall on the snowy asphalt.

Ms. Flentje, age 24 at the time, sustained a severe fracture to her lower right leg/ankle which required surgery to insert a metal plate and screws and resulted in a large scar. Due to her injuries, Ms. Flentje was unable to return to her job as an office clerk for three months. On August 12, 2003, she underwent further surgery to remove the plate and screws. Whitby Woman Sues Town of Whitby after Sidewalk Slip & Fall

The Lombard v. Town of Whitby court decision was released by the Ontario Superior Court of Justice on June 11, 2007.

On June 29, 2005, Harriet Lombard went for an early morning walk in the Town of Whitby. While walking, she fell on the sidewalk in the area of several cracks in the sidewalk. She sustained a broken elbow and cuts to her knee and face.

On the day of the fall, Mrs. Lombard re-attended at the scene with her husband and took photos of the area where she fell. They noted that one the cement slabs was 1 inch lower than the other which caused the sidewalk to be uneven. Read the rest of this entry »

Surgeon Sues City of Windsor after Bike Accident

The Yovanovich vs. City of Windsor court decision was released by the Ontario Superior Court of Justice on May 31, 2007.

On the morning of Saturday June 16, 2001, Dr. Robert Yovanovich, an orthopaedic surgeon was cycling on Prince Road in Windsor at a reasonable speed. This portion of Prince Road had previously been closed to traffic for it’s reconstruction but re-opened in December 2000, despite being unfinished. The barricades and detour signs had been removed and the road was open to traffic.

Dr. Yovanovich suddenly heard the sound of a dump truck that was approaching from his rear. As he moved to the right to avoid the dump truck, he cycled over an elevated catch basin and was thrown into the air and then into the ground. Read the rest of this entry »
