Vancouver Woman Slips and Falls on Stairs Exiting Fish Store

The Dufault v. Kathed Holdings Ltd. (c.o.b. Regent Fish) decision was released by the British Columbia Supreme Court on February 7, 2007.

On April 17, 2000, Denise Dufault, age 35 at the time, exited the rear entrance of Regent Fish Store when she slipped and fell on the stairs. The floor tiles, which had been tacked or nailed to the stairs, were extremely worn, broken, and cracked. As a result of the fall, Ms. Dufault suffered a serious knee injury which required the insertion of a plate. She went on to develop a degenerative arthritic condition in her knee which would require knee replacement surgery.

Ms. Dufault hired a Vancouver personal injury lawyer and sued Regent Fish Store for damages arising out of the slip & fall. Read the rest of this entry »

Calgary Man Sues for Malpractice after Doctor Misdiagnoses Ankle Injury

The Thibert v. Zaw-Tun decision was released by the Alberta Court of Queen’s Bench in Calgary on June 9, 2006.

On January 28, 1999, Denis Thibert, then 27 years old, while helping his sister move furniture to a new residence, jumped approximately two and half feet from the back of a pick-up truck with a dresser in his hands, and suffered an injury to his left ankle. When he got up the next morning the pain was excruciating, tremendous and the worst he had ever experienced.

Mr. Thibert immediately attended on Dr. Zaw-Tun at the Horizon Square Medicentre in Calgary. His ankle was x-rayed and Dr. Zaw-Tun diagnosed the injury as a severe sprain. Read the rest of this entry »

Widow Sues Town of Oakville after Tragic Bicycle Accident

The Johnson v. Corporation of the Town of Milton was released by the Ontario Superior Court of Justice on July 28, 2006.

On the afternoon of September 13, 1992, Nelly and Robert Johnson decided to go for a bicycle ride on their tandem bicycle along the scenic Fourth Line in the Town of Oakville. They suddenly lost control of the bicycle while traveling north towards the Glenorchey Bridge. They failed to negotiate a sharp right hand turn and collided with the rock embankment. Robert Johnson was killed in this accident and Nelly Johnson was seriously injured. Nelly Johnson started a lawsuit against the Town of Oakville for negligence, claiming that the accident was caused as a result of the non-repair of the Fourth Line. Read the rest of this entry »

Vancouver Woman Sues after Dump Truck Collides with her Car

The Ashcroft v. Dhaliwal case was released by the British Columbia Supreme Court on April 20, 2007.

On October 27, 2003, Elisabeth Ashcroft, age 58, was injured when the left side of her small sports car was struck by a dump truck. She was not at fault and liability for the collision had been admitted by the driver and the owner of the dump truck. Her personal injury lawyer started a lawsuit as a result of the accident.

One year later, on October 20, 2004, Mrs. Ashcroft was involved in another accident, this time as a passenger in the front seat of a car that was struck by another vehicle. When the second accident took place, the injuries suffered by Mrs. Ashcroft in the first accident had not yet resolved. Read the rest of this entry »
