The Lombard v. Town of Whitby court decision was released by the Ontario Superior Court of Justice on June 11, 2007.
On June 29, 2005, Harriet Lombard went for an early morning walk in the Town of Whitby. While walking, she fell on the sidewalk in the area of several cracks in the sidewalk. She sustained a broken elbow and cuts to her knee and face.
On the day of the fall, Mrs. Lombard re-attended at the scene with her husband and took photos of the area where she fell. They noted that one the cement slabs was 1 inch lower than the other which caused the sidewalk to be uneven. Read the rest of this entry »

The Wensel v. City of Calgary court decision was released by the Alberta Court of Queen’s Bench on April 5, 2007.
On April 2, 2003, Marlene Wensel (then age 62) was stopped at a red light when she was suddenly rear-ended by a City of Calgary bus. After exchanging information with the bus driver, she drove home and went about her normal day.
That night Ms. Wensel began to get pain in her upper arm and lower back. The next morning she went to a walk-in clinic where she was diagnosed with a whiplash injury and prescribed a muscle relaxer and pain killer. The Adamson v. Charity decision was released by the British Columbia Supreme Court on May 14, 2007.
On October 9, 2000, Roger Adamson (then age 42), a home renovator and contractor for Home Depot, was driving his Ford pickup truck when an SUV driven by Donald Charity ran a stop sign and “T-Boned” him at the intersection of Nanaimo and Market Streets in Victoria, B.C. Mr. Adamson’s truck was pushed across the intersection by the force of the collision. It struck the curb, bounced off a boulevard tree and landed on the passenger side door. The emergency crew had to use the “jaws of life” to remove Mr. Adamson from his truck.
Notwithstanding the dramatic accident scene, it initially appeared that Mr. Adamson’s injuries were relatively minor. Read the rest of this entry »

The Thiessen v. Selke decision was released by the Alberta Court of Queen’s Bench on April 11, 2007.
On 1 November, 2000, Carey Lynn Thiessen, then age 29, was driving a motor vehicle when she slammed into another motor vehicle that turned quickly in front of her at a traffic intersection in Brooks, Alberta. She did not lose consciousness and she got out of her vehicle on her own. The police took her to the Brooks Hospital where she was examined, prescribed some over the counter medication, and released her.
As a result of the accident, Ms. Thiessen suffered a moderate whiplash injury which included symptoms of neck stiffness, pain in the back of her neck and shoulders, headaches and pain in the lower back. The accident caused a lumbosacral strain with a L5-S1 disc disruption and a left-sided disc bulge. Read the rest of this entry »

The Yovanovich vs. City of Windsor court decision was released by the Ontario Superior Court of Justice on May 31, 2007.
On the morning of Saturday June 16, 2001, Dr. Robert Yovanovich, an orthopaedic surgeon was cycling on Prince Road in Windsor at a reasonable speed. This portion of Prince Road had previously been closed to traffic for it’s reconstruction but re-opened in December 2000, despite being unfinished. The barricades and detour signs had been removed and the road was open to traffic.
Dr. Yovanovich suddenly heard the sound of a dump truck that was approaching from his rear. As he moved to the right to avoid the dump truck, he cycled over an elevated catch basin and was thrown into the air and then into the ground. Read the rest of this entry »
