Lumbar Yard Gate Crashes Down on Woman’s Head Causing Severe Injury

The Whetung v. West Fraser Real Estate Holdings Ltd. court decision was released by the British Columbia Supreme Court in New Westminster on August 24, 2007.

On May 31, 2001, Jessica Whetung visited the Revy Store in White Rock, British Columbia along with her mother and sister. Suddenly, while standing near the garden supplies section of the store, the heavy wooden arm of the lumbar yard gate fell down on top of her head. Another store customer was struck across the shoulder.

As a result of the accident, Ms. Whetung, then a 25 year old ski instructor, developed dystonia, a crippling neurological disorder characterized by involuntary contractions of many of the major muscle groups in her body. Read the rest of this entry »

Trucker Sues Mutual Life after Disability Benefits Terminated

The Brown v. Mutual Life Assurance Co. of Canada court decision was released by the Alberta Court of Queen’s Bench in Edmonton on August 8, 2005.

Darryl Brown was working as truck driver for Smokey Coal mine in Grand Cache Alberta. He was required to drive over rough surfaces, sometimes almost falling out of his seat.

In September 1988, Mr. Brown had a “runaway” incident. His truck brakes failed and the truck went down a 600 ft. ramp. He suddenly felt a “big snap” on the right side of his lower back when the truck crashed into the bottom of a second ramp. From this point forward, he started experiencing back problems. Passenger Sues for Injuries after Driver Crashes into Cement Barrier

The Clark v. Hebb court decision was released by the British Columbia Supreme Court in Vancouver on June 19, 2007.

V.H. was driving D.C. and two other friends to a social event on the night of August 20, 2002. Suddenly, Ms. H lost control of her Hyundai vehicle and crashed into the cement barrier. D.C., then 29 years old, was sitting in the front passenger seat of the car.

As a result of the accident, he claimed that he suffered severe and disabling injuries, including a brain injury. Mr. C hired a Vancouver injury lawyer and sued Ms. W for damages he suffered from the accident. Read the rest of this entry »
