Pedestrian Severely Injured After Hit by Car while Crossing Highway

The Moses v. Kim court decision was released by the British Columbia Supreme Court on September 19, 2007.

After a morning of fishing, Antoine James Moses was walking across the Trans Canada highway near Lytton, B.C. on September 11, 2002 when he was struck by a 2002 Buick driven by Taehun. Kim. He was thrown high into the air and tumbled hard into the ground.

Mr. Moses was taken to Royal Inland Hospital in Kamloops, B.C. He had bilateral fractures of the tibia quite low on both legs. The fracture of his right leg was a severely splintered comminuted fracture with a big separated fragment. The bone actually broke through the skin on both sides. His bones were slow to heal and his recovery was complicated by infections and other problems. He was required to undergo 13 or 14 surgeries and spent weeks in hospital. Vancouver Bicyclist Sues After Being Hit by Motor Vehicle

The Laroye v. Chung court decision was released by the British Columbia Supreme Court in Vancouver on October 2, 2007.

Stephen Laroye, a 38 year old architect intern, was bicycling home from work when he was knocked to the ground in a collision with a car driven by Kam Chung. He suffered bruises and abrasions to his left elbow, left knee, left calf, left ankle and left hip and also an injury to his neck and shoulders. His most significant injury was to his left hip area over the greater trochanter. This area was severely bruised and developed chronic trochanteric bursitis. Also, the neck injuries suffered in this accident aggravated injuries received in two motor vehicle accidents in 1998.

Mr. Laroye was taken from the accident scene to Vancouver General Hospital on a spinal board due to concerns about his neck. Read the rest of this entry »

Teenager Becomes Quadriplegic after Pool Slide Accident

The Walford (Litigation guardian of) v. Jacuzzi Canada Inc. court decision was released by the Ontario Court of Appeal on October 23, 2007.

Marion Walford’s family owned an aboveground backyard pool which they bought in 1994. Ms. purchased a second-hand slide for the pool which she found in a classified ad.
After purchasing the slide, Mrs. Walford loaded it into her van and drove directly to a Pioneer Pools store in Hamilton.  There she showed to the store manager and asked whether it was all right to use this slide with her 4-foot pool. She was told that there would be no problem and thus she installed the slide.

Ms. Walford’s daughter Correena was 15 years old when she went down the slide head first. She hit her chin on the bottom of the pool and broke her neck. Correena Walford was rendered quadriplegic by the accident. Read the rest of this entry »
