The Rollins v. Lovely court decision was released by the British Columbia Supreme Court in Vancouver on December 3, 2007.
On July 23, 2002, Scott Rollins, then a 28-year old off-duty police officer, decided to go shopping at a mall in Burnaby, B.C. with his girlfriend. They were stopped at a median, waiting to cross westbound lanes to get into the mall entrance. Seeing that there were no oncoming vehicles, Mr. Rollins crossed the westbound lanes when he was suddenly struck by another vehicle. The driver of that vehicle, Ronald Lovely, had just turned right into the westbound lanes, was distracted, was not watching the roads, and collided into Mr. Rollins’ car. The Bjornson v. Field court decision was released by the British Columbia Supreme Court in Powell River on December 21, 2007.
On June 3, 2003, 57 year old Pauline Bjornson was out running errands in the afternoon. She waited at an intersection for the walk signal, stepped onto the crosswalk, started crossing the street when suddenly a vehicle turning right struck her.
The force of the impact threw Ms. Bjornson onto the hood and windshield and she turned a full summersault before landing on her head and shoulder on the pavement. She was dazed, had a short period of loss of consciousness, and struggled to get up. Read the rest of this entry »

The Kosy v. Peyre Chrysler Ltd. court decision was released by the Alberta Court of Queen’s Bench in Lethbridge on December 19, 2007.
On May 7, 2003, driver Margaret Cunningham and passenger Cheryl Cunningham were driving on the highway when the left rear wheel of their jeep suddenly came loose and fell off. Immediately the rear left end of the jeep hit the pavement and the vehicle swerved until finally coming to a stop. Both driver and passenger developed moderate whiplash symptoms as a result of the accident.
Five days earlier, Ms. Kosy had taken the jeep to the car dealership for servicing and repairs. Read the rest of this entry »
